The plaintiff in error, hereinafter referred to as the defendant, was by information charged with stealing and carrying away one Hereford steer coming three years old. The jury returned a verdict against the defendant finding him guilty of stealing a domestic animal, and. leaving his punishment to the court. The court sentenced the defendant to imprisonment in the state penitentiary for a period of seven years and to pay all costs of the prosecution; from which judgment the defendant appeals.
