LANE, Justice.

At a former day of the present term of this court, all members of the court sitting, we prepared and caused to be filed an opinion in this cause affirming the judgment of the trial court. After such preparation and filing, it was made known to us for the first time, by motion of appellant, that Associate Justice GRAVES was disqualified to sit in the cause. Upon such disclosure, the majority of this court upon reconsideration of the cause have and do hereby set aside said opinion, and upon such reconsideration have’ reached the conclusion that the judgment of the trial court…
