Reversing.

This action was -first instituted by filing a petition in which appellant attempted to set aside a deed upon allegations that same was procured from him by false and fraudulent representations alleged to have been made to Mm by Ms brother, Stanley Maas. A demurrer was sustained to this petition. Appellant then filed Ms first substituted petition in equity in which he attempted to set up a cause of action to have the deed in question declared to be a mortgage.
