This suit involves the validity of a written contract between the city of Breckenridge, a municipal corporation, and the county of Stephens, dated November 23, 1926. Breckenridge was first incorporated under the commission form of government plan, with a population of over 1,000 and less than 5,000, with the powers given in R.S. 1925, art. 1163. Afterwards, by resolution, the city council adopted in lieu of its existing charter the provisions of title 28, relating to cities and towns, as authorized by R.S. 1925, art. 961.
