PRENDERGAST, Presiding Judge.

This is an appeal from a misdemeanor conviction for a violation of the prohibition law against the sale of intoxicating liquors. The offense is alleged to have been committed on April 3, 1913. The case was tried in May, 1913.

There is but one question in the case necessary to decide. The record shows that in 1877, in justice precinct No. 3, of Nueces County, an election was held, carried and the law put in force in that precinct prohibiting the sale of intoxicating liquors therein; that no such prohibition election since then has ever been held in that same…
