This was an action on the case, brought to December term 1829. The writ was returned “ summoned.” The cause was regularly put at issue on the plea of non asmmp-serunt, and of discharge under the insolvent laws of this state. While at issue, it was arbitrated under the act of 1810 ; and on the 29th of December 1830, judgment was entered on the award of arbitrators for 3038 dollars 72 cents. On the 8th of January 1834, the judgment was assigned to P. Bousquet, and marked to his use.
