Defendant was duly charged with the crime of murder of the first degree in the following language: “That the said defendant, Ralph Golden, on or about the 30th day of September, 1946, in Ada County, State of Idaho, then and there being, did then and there wilfully, unlawfully, knowingly, feloniously and with malice aforethought, and with intent to kill and murder one Mildred L.
