FOSTER, Justice.
This appellant was convicted of murder in the second degree, and his punishment fixed at ten years in thé penitentiary. The deceased was Lawrence Rogers, and was killed on the night of April 12, 1944. The defendant lived with his father, ' Willie Stallings,* his mother and sister on the east side of the Plonoraville arid Black Rock Road extending north and south.
