OPINION

PARKER, Judge.

This negligence action was brought by Paul and Marilyn Ruppert against David Yaeger for injuries allegedly sustained in a boating accident. After the jury verdict, the Rupperts moved for a new trial pursuant to Minn.R.Civ.P. 59.01 (5) and (7) or, in the alternative, for judgment notwithstanding the verdict. The trial court denied the Rupperts’ motion and they appeal from its order and judgment. We affirm.
