In April, 18Y9, Lester Drake was interested as owner in the Williams lode, situated in Gilpin county. The extent of such interest is immaterial, as he held contracts with the- other owners giving him -the right, for the time being, to sell the entire property. The plaintiff had been unsuccessful in his efforts to make such sale until he met defendants Weitbrec and Cooper.
