This is an appeal from an order or judgment overruling plaintiff’s motion to vacate a judgment in favor of plaintiff and against the defendant.

The facts show that on the 5th "day of March, 1925, Messrs. Pross T. Cross and Maurice P. Murphy, attorneys at law, filed in the circuit court -of Buchanan county a suit for damages in the name of plaintiff and against the defendant. The petition - alleged that on the 1st day of February, 1921, plaintiff, while employed by the defendant in its packing plant in St. Joseph, was injured by falling into an elevator shaft in one of the defendant’s…
