Error to the Court of Common Pleas of Schuylkill county: No. 167, to January Term 1870. This was an action of ejéctment brought April 3d 1856, by ' John Green against Thomas J. Atwood, for a tract of land in Foster township, containing 350 acres of land or thereabouts, and bounded by lands surveyed on warrants granted to John Hartman, John Kunkle, Christina Levenburg and others. The Manhattan Coal Company were on the 3d of November 1869, substituted as defendants.

John Green, the plaintiff below claimed title under a warrant in the name of' Philip Myer, one of a block of thirteen surveys made by Henry Yanderslice, deputy-surveyor, on the 18th to the 25th of May 1794.
