Proceeding pursuant to CPLR article 78, inter alia, to review a determination of the respondent Commissioner of the New York State Department of Social Services, dated June 29, 1989, which, after a hearing, disqualified the petitioner from participation in the Medicaid program.

Adjudged that the determination is confirmed and the proceeding is dismissed on the merits, with costs to the respondent State Commissioner.
