*465This is a proceeding under section 5490 of the Code by the plaintiff in error against the defendant in error to establish the boundary line between them as coterminous owners. The parties waived a jury and submitted all matters of law and fact to the determination of the trial court which rendered judgment in favor of the defendant. To that judgment the plaintiff in error, which was the plaintiff in the trial court, assigns error.
