This suit was instituted in the circuit court of Scott county against appellee, seeking to recover damages for the injury and death of Minor Gunter, a minor, about fifteen years of age, who died from injuries sus tained while working at or around an alleged defective and dangerous piece of machinery in appellee’s sawmill.
