Appeal from District Court, Latimer County; Malcolm B. Rosser, Judge. Woodie Watson was convicted of an assault with intent to rape, and his punishment was assessed at a fine of $500 and imprisonment in the county jail of Latimer county for one year, and he appeals.

The Attorney General has filed the following confession of error in this case:

“The information in this case charges the defendant with assault with intent to rape Vera McCarty on or about the 31st of July, 1910, in Latimer county, state of Oklahoma. Trial was duly had before the district court of said county, and defendant was found guilty. The cause was brought up to this court on appeal from the judgment and sentence of the district court.
