LURTON, Circuit Judge.
At the conclusion of all the; evidence, the plaintiff in error moved for an instruction to find for the defendant, which was overruled. This *722lias been assigned as error, and lias necessitated the examination of a very voluminous record, containing all the evidence submitted to the jury.
