At the general election held in the county of Monroe on the fourth day of November, 1902, the appellant and the appellee were opposing candidates for the office of county treasurer of said county,—the appellant being the nominee of the republican party and the appellee the nominee of the democratic party. The votes cast at said election were canvassed by the county clerk and two justices of the peace of the said county, and the appellant was declared to have been elected to the said office by a majority of nine votes and a certificate of election was issued to him.
