In this suit instituted by appellant, E. L. Ellingstein, against appellees, Russell P. Eagle and T. A. Derrer, it was alleged and is now asserted that a partnership contract was entered into between the three parties for the purpose of obtaining and conducting a “sales and distributing agency” for Lincoln and Mercury automobiles in which each was to invest a stated sum of money and would participate equally in the net profits from the business, and that appellees breached the contract by wrongfully obtaining the dealer’s agency for themselves which they exercised to the exclusion of…
