Appellant was charged by indictment for the offense of burglary of a habitation. V.T.C.A., Penal Code, Section 30.02 (1989). A jury found him guilty as charged, found two enhancement paragraphs true, and sentenced him to eighty-seven years of confinement.

The Court of Appeals affirmed appellant’s conviction, 905 S.W.2d 735 (Tex.App.—Houston [14th Dist.] 1995), and he filed a petition for discretionary review with this Court alleging two grounds for review. We granted appellant’s first ground for review in order to decide whether “the…
