This matter is before the court upon a motion by defendant for summary judgment.

PROCEDURAL AND FACTUAL HISTORY

Plaintiffs initiated this action by summons on November 23, 1983. On December 27, 1983, defendant ruled plaintiffs to file a complaint which plaintiffs did on January 27, 1984. On March 9, 1984, defendant filed an answer and new matter to plaintiffs’ complaint and demanded a jury trial.
