KNOCH, Circuit Judge.

Plaintiff, Franklin S. Wallace, brought this action in the United States District Court to compel the defendant City of Rock Island to return $52,314.80 to a sinking fund established for the retirement of bonds issued to finance construction work on the Rock Island Centennial *638Bridge, a toll bridge spanning the Mississippi River from Rock Island, Illinois, to Davenport, Iowa.
