Kinney, J.

Ray and Burge were jointly indicted for larceny, at the March term, 1848, in Henry county. Ray pleaded “not guilty,” and demurred to the indictment, which was overruled. He obtained a separate trial; and at the same term of the court was tried and convicted, and sentenced to imprisonment, in the penitentiary, for three years. The defendant then sued out a writ of error to this court, procured a supersedeas to stay the judgment of this court below, and the case appears before us upon three bills of exceptions taken on the trial, embodying all the evidence, with the…
