Appeal from judgment on report of referee. Action by Harmon H. Hart against Theodore W. Myers and Edward H. Myers for an accounting of the partnership business of the firm of Theodore W. Myers & Co. Plaintiff appeals.

The principal object of this action was to settle the accounts of a partnership previously existing between the plaintiff and the defendants. It was formed by a written agreement made on the 31st of December, 1888, and to continue to and terminate on the 31st of December, 1890, with the privilege, however, to end the partnership on the last day of December, 1889.
