(Dissenting). — The purpose and unquestioned object of this proceeding is to remove the deferid*459ant from the actual possession of the office of Governor, and thereby deprive him of the facilities with which to exercise the functions of the office — to depose defendant as the de facto Governor, and install the plaintiff into such office as such de facto officer pending the final determination of the contest instituted by the defendant against the plaintiff on December 6, 1916.
