At the December term, 1871, of the criminal court of Cook county, the grand jury found an indictment against plaintiff in error, charging him with the murder of Daniel O’Brien. After the cause ivas twice continued, it ivas tried at the April term, 1872, and resulted in a verdict of murder, and the jury fixed death by hanging as tlie penalty.
