CHRISTIAN, Judge.

The offense is murder, the punishment confinement in the penitentiary for 99 years.

This is the second appeal of this case, the former appeal being reported in 291 S. W. 540. The reversal was based on the insuf ficiency of the evidence. Practically the same questions are presented by the instant record, and the evidence is largely the same as that shown in the record of the former appeal. The state offered additional testimony in the present trial, which it is contended sufficiently corroborates the accomplice Furl.
