1Opinion of the CourtEmery, J.
The Kennebec Savings Bank, and the Augusta Savings Bank, each filed a bill in equity to have John B. Fogg, Executor of the will of Amos C. Hodgkins, deceased, and Emery O. Beane, Administrator of the estate of Mary J. Hodgkins, deceased, interplead as to the ownership of certain sums of money on deposit in each bank. By agreement of all parties, the cases are reported to the law court, to be there heard and determined as a case between the two estates.
In determining the ownership of these deposits, the first inquiry naturally is, — what is shown by the books of the banks and by the pass-books…
