—In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Richmond County (Leone, J.), dated May 2, 1989, which denied his motion for partial summary judgment as to liability against the defendants the City of New York and Sylvestri Contracting Corporation based upon a violation of Labor Law §241.
Ordered that the order is affirmed, with one bill of costs.
