The plaintiff is the widow of one Steele Mitchell who died on December 2,1940. Prior to his death, the deceased, who was president of a large corporation, lived with plaintiff in an apartment at 1010 Fifth avenue, county and city of New York. The defendants, Carrie L. Mitchell, Lucy R. Brown and James S. Brown, are the mother, sister and nephew, respectively, of the deceased and are beneficiaries named in certain life insurance policies issued to the deceased.
