This case came before the Supreme Court on April 7,1999, pursuant to an order directing the parties to appear and show cause why the issues raised by this appeal should not be summarily decided. The plaintiff, Michelle Asermely, as the assignee of Mark Rendine and Julieanne Bernier, has appealed from a summary judgment in favor of the defendant, Allstate Insurance Company (Allstate), on counts 1, 3, and 4 of her complaint.
