CECIL, Chief Judge.

Cas L. Cordle, a seaman and plaintiff-appellee, hereinafter called plaintiff, brought an action under the Jones Act, -in the United States District Court for -the Eastern District of Kentucky, against 'Allied Chemical Corporation, defendant-appellant, hereinafter called defendant, to recover damages for injuries alleged to have been caused by its negligence.

The defendant has a plant on the Ohio River, at Ashland, Kentucky, where it makes coke. It transports coal from its mines in West Virginia to the Ashland plant in barges propelled by motor vessels, one of which is called…
