Mabry, J.:

Plaintiff in error was indicted for the murder of one S. P. Morgan and was convicted of manslaughter. From the sentence of the trial court a writ of error has been prosecuted.

A witness having testified that she knew the defendant, Kennard, and the deceased, Morgan, was asked if she heard any conversation between them a short time before the homicide, and' replied that she was not sure, whether it was Kennard; that the conversation helard took place on the square (of Gaines-ville, Fla.) as witness was passing and it was almost dark.
