This suit was commenced before a justice of the peace of Ford county, Kansas, by George V. Bartlett against The Atchison, Topeka & Santa Fe Railroad Company, to recover the value of two certain colts alleged to have been killed by the engine and cars of said railroad company. Plaintiff sets out two causes of action in his bill of particulars. The first is brought under chapter 94, Laws of 1874, commonly known as the “stock-killing law,” and alleges that where the colts entered upon the railroad track and where they were killed the track…
