MORROW, Presiding Judge.
— The conviction is for murder; punishment fixed at death.
Appellant’s written confession was introduced in evidence in which he stated, in substance, that he and his wife had not lived happily for some four or five years; that she was jealous and accused him of infidelity; that on several.occasions, at her instance, he had moved; that he had threatened to leave but refrained from doing so on account of his affection for the children; that on July 3rd, the appellant, the deceased and her mother went to Waco.
