This is the second appeal of this case. The former one is of the same style and reported in 271 Ky. 473, 112 S. W. (2d) 666, and onr opinion was rendered January 14, 1938. It is an action brought by appellee and plaintiff below, Henderson County Board of Education, against appellant and defendant below, Clair A.
