The three above-captioned, nationwide class actions were filed against Capital One, its subsidiaries, and its Participating Vendors (collectively, “Defendants”),1 as a result of the Defendants’ allegedly using automatic telephone dialing systems or artificial or prerecorded voice messages to contact consumers’ cell phones without pri- or express consent, in alleged violation of the Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227(b)(1)(A).
