The appellant, Georgia Noble, owned a tract of land, and, in erecting a dwelling bouse upon it, purchased a portion of the materials used from the Jackson Lumber & Supply Company. The latter company to secure the payment of its debt asserted a lien upon the tract of land, as provided by chapter 79, Kentucky Statutes, and there*550after instituted an action in the circuit court of the county to recover a judgment for its debt, and to enforce its lien apon the land.
