The first question is, whether the parties have a right of trial by jury. By article twenty of our bill of rights, it is provided that in all controversies concerning property, and in all suits between two or more persons, except in cases in which it has heretofore otherwise been practised, the parties have a right to trial by jury. As to the first part of the provision, we have no doubt that under our decisions this proceeding must be regarded as a controversy concerning property within the meaning of this constitutional provision.
