Appeal from Court of Civil Appeals of Second Supreme Judicial District. Action by Fayette Holcomb against the Western Union Telegraph Company. Judgment for plaintiff was affirmed by Court of Civil Appeals (175 S. W. 750), and defendant brings error.

This suit - was brought by Fayette Holcomb against the telegraph company to recover damages on account of an alleged negligent failure on the part of the company to deliver a telegram informing him of the serious illness of his brother, Jess Holcomb.

The plaintiff alleged that by reason of the negligence of the company he was prevented from being present at his brother’s funeral.

As the plaintiff in error relies entirely upon the insufficiency of the evidence, it is necessary for us to set out such of the facts as we deem necessary to support the conclusion reached by us.
