The relator was a member of the police force of the city of Hew York on the 15th of April, 1857, when the act of the legislature was passed to establish the metropolitan police district, &c.
The 32d section of that act continued the then existing *528officers and patrolmen in the performance of police duty under the new hoard thereby created. The duties and purposes of the new force were precisely the same as those of the old.
