On July 9, 1923, at about ten minutes of J o? clock in the morning, the appellant, Eiehard M. Merrifield, was struck, knocked down, and seriously injured by a truck admittedly belonging to the defendant, and at that time being driven by a servant of the defendant admittedly acting within the scope of his employment and upon the defendant’s business. To recover damages as compensation for the injuries sustained, the appellant instituted suit in the Baltimore City Court against the defendant below (appellee, here), the O.
