MEMORANDUM OPINION

HANSEN, Vice-Chief Judge:

Appellants, “University”, seek review of the trial court’s order which sustained Ap-pellee Stern’s motion for summary judgment. Stern brought this action for breach of contract and violation of due process when the University declined to offer Stern a tenured teaching position at the University of Oklahoma. For the reasons herein discussed, we must reverse the trial court’s order.
