PHILLIPS, Circuit Judge.

This is a suit for a declaratory judgment brought by Schwartz Sales Company1 against Steiner Sales Company2 under the provisions of 28 U.S.C.A. § 400.

In its complaint Schwartz challenged the validity of certain patents owned by Steiner and the validity of certain contracts entered into by .Steiner with its licensees on the ground that the contracts violate Section 1 of the Sherman Act and Section 3 of the Clayton Act (15 U.S.C.A. §§ 1, 14), alleged that an actual controversy existed between it and Steiner with respect thereto, and prayed for a decree adjudging the…
