DAVIDSON, Presiding Judge.
This conviction was for theft from the person, the punishment being five years confinement in the penitentiary.
Appellant is a negro woman. The State’s theory of the case is that she took $60 odd dollars from the pocket of a young man named Handy while they were in the act of sexual intercourse. Appellant’s defensive theory was alibi, and she introduced quite a lot of testimony in support of her contention.
