Appeal from a judgment of the County Court of Albany County (Herrick, J.), rendered March 26, 2014, which revoked defendant’s probation and imposed a sentence of incarceration.

Defendant, a French-speaking refugee from the Democratic Republic of Congo, pleaded guilty to welfare fraud in the third degree and was sentenced to time served, five years of probation and restitution in the amount of $9,511.60 to be paid in monthly installments. Two years later, he was charged with violating the conditions of his probation by, among other things, failing to report to his probation officer as directed…
