Appeal from District Court, Cottle Coun ty; Jos. A. P. Dickson, Judge. Trespass to try title by Mrs. R. A. Harbin-son against Cottle County. From a judgment for defendant, plaintiff appeals.

In this case, appellant sues appellee in trespass to try title to recover certain land described in her petition, and for damages. Said petition is as follows, omitting the formal parts:

“(1) That plaintiff is a resident citizen of Cottle county, Tex., and that the defendant is a political subdivision of the state of Texas, with W. E. Prescott as the presiding officer of the commissioners’ court and judge of the county court of said defendant county, upon whom service of citation may be had.
