HOLMAN, Commissioner.

Defendant, Maurice L. Fuller, was charged with the murder (second degree) of Larry Fertig. Upon trial he was found guilty of manslaughter and his punishment fixed at a fine of $500 and imprisonment in the county jail for a period of twelve months. He appeals from the ensuing judgment.

According to the evidence' for the State it appears that deceased died shortly after the termination 'of a fight which occurred between defendant and deceased, at about 2 a. m. on January 29, 19S5, at the home of Hazel and Frederick Ballman in St. Louis County, Missouri. An autopsy revealed…
