INTRODUCTION

This writ proceeding concerns the applicability of Code of Civil Procedure section 340.9, which revives certain claims that owners of property damaged in the Northridge earthquake have against insurance companies. By its terms, section 340.9 does not revive a time-barred claim that has been “litigated to finality in any court of competent jurisdiction prior to the effective date of this section.” (§ 340.9, subd.
