*462In an action, inter alia, to recover damages for false arrest and imprisonment, assault and battery, malicious prosecution, and deprivation of civil rights pursuant to 42 USC § 1983, the plaintiff appeals, as limited by his brief, from so much of an order of the Supreme Court, Kangs County (Partnow, J.), dated April 13, 2005, as denied his motion for leave to enter a default judgment against the defendant Dion Edwards upon his failure to appear or answer.
Ordered that the order is affirmed insofar as appealed from, with costs.
